1.払い戻しなし

XAppSetの商品の性質上、すべての購入および販売は、以下の条件に従って行われます。 ファイナル.ただし、XAppSetは、払い戻し要求に対して、その都度、独自の判断で対応する権利を留保します。製品の不具合、バグ、または同様の問題により返金を希望される場合は、本EULAの末尾または利用規約に記載されているXAppSetまでご連絡ください。

2.ファイルのプレビュー

利用規約の第3.2項に記載されている通り、ご購入の前に、以下の事項をご確認ください。 XRecovery ftud, XRecovery pro、 または XRecoveryエンタープライズ, you should first follow the Preview Process. If your file(s) is not fully previewable, the file(s) may still be recoverable. However, XRecovery cannot guarantee recovery as the failure to preview may be due to internal file errors, fragmentation, data overwriting, encryption, file system peculiarities, or limitations of your operating system itself. In this case, XAppSet suggests that you contact XAppSet to learn about possible risks of failure to recover and information on how recovery chances can be increased. If your file(s) were fully previewable but recovery still failed, please contact XAppSet for assistance, as outlined at the end of this EULA or in the Terms of Service.

3.回復の見込み

If your copy of XAppSet’s Products is equipped with the functionality to predict and calculate the recovery chances for certain types of files, please follow the guidelines in the Product Documentation (User Guide), this EULA, and XAppSet’s website. The recovery chances estimation equips users with more tools to determine whether their data is recoverable and helps with sorting through all potentially recoverable data pieces faster. These recovery chance estimates are not guaranteed and should be treated as informational only. XAppSet’s Refund Policy still prevails, and according to Section 6.2 above, the only reliable method of verifying the recoverability of one’s data is ensuring the perfect preview of the data listed by XAppSet’s Products as recoverable.

4.欧州連合（EU）居住者

Because of the nature of XAppSet’s Products, if you are an EU resident, upon purchase of any XAppSet Product you will lose your right of withdrawal under the Consumer Rights Directive (“CRD”) 2011/83/EU of the European Parliament and of the Council of 25 October 2011. Your loss of the right of withdrawal is based upon CRD Article 16(m), which omits the purchase of “digital content” (e.g., downloaded software) from the right of withdrawal. By purchasing an XAppSet Product, you expressly consent to the contract’s execution and acknowledge the waiver of your withdrawal right. You agree to use the Product or any services provided hereunder only for purposes permitted by the EULA and applicable Terms of Service as well as any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions. XAppSet IS NOT LIABLE FOR ANY VIOLATION OF APPLICABLE LAWS, RULES, OR REGULATIONS COMMITTED BY YOU OR A THIRD PARTY AT YOUR BEHEST. IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOUR USE OF THE XAppSet PRODUCT AND ANY SERVICES PROVIDED THEREUNDER DOES NOT CONTRAVENE APPLICABLE LAWS, RULES, OR REGULATIONS.

6.契約期間と解約

本EULAの有効期間（以下「有効期間」といいます）は、お客様が本製品をダウンロードまたはインストールした時点（いずれか早い時点）から開始し、本契約に基づき解除されない限り、永続的に、または本契約に基づき付与されるライセンスで指定された期間、存続するものとします。XAppSetは、本製品、または本製品の代替バージョンもしくは変更バージョンに対する上書きのEULAをお客様に提供し、お客様が当該上書きのEULAに同意することを条件として、本製品、当該代替バージョン、変更バージョンもしくはアップグレード バージョン、または新リリースを引き続き使用することにより、本EULAを終了することができます。また、お客様が本EULAに基づく義務または条件に従わない場合、XAppSetは本EULAを予告なく直ちに解除することができます。お客様が本EULAに含まれるいずれかの条項に違反した場合、お客様は、XAppSetに対して、当該違反のフラグを立て、報告することができます。XAppSetは、独自の裁量で、お客様のXAppSetユーザーアカウント（利用規約で定義）を停止し、またはお客様のサービスを終了することができます。XAppSetは、お客様が本規約に記載された制限またはその他の要件に従わなかった場合、その理由を問わず、いつでも、予告なく、お客様に対して責任を負うことなく、本サービスまたはお客様の本サービスへのアクセスを変更または終了する権利を留保します。本EULAが終了または満了した場合、お客様は直ちに本製品の使用を中止し、本製品のすべてのコピーを破棄しなければなりません。

7.解約時の権利の不存在

本EULAが終了すると、お客様は本製品を操作または使用する権限を一切失います。

8.重要な取引条件

本第6.5条を制限することなく、お客様は、本第6条の各条項が重要であること、およびお客様がこれらの条件に従わない場合、XAppSetが本EULAおよび本EULAに基づいて付与されたライセンスを直ちに解除する十分な理由となることに同意するものとします。本第6.7条の存在は、いずれかの当事者による本EULAのその他の条項または違反の重要性を判断する上で意味を持たないものとします。

9.統計

お客様は、XAppSetが、(i) お客様による本製品および関連サービスの利用を促進するために、お客様のコンピュータ、お客様が使用または検索した本製品、お客様が訪問したウェブサイト、または閲覧したページに関する匿名情報を収集、分析、受信すること、および (ii) XAppSetがお客様へのサービスを向上させるために、お客様のインターネットブラウザ（Internet ExplorerまたはChromeなど）からブックマーク、クッキー、プラグイン、ウェブビーコン、および設定などの特定の情報をインポートすることを了承し、同意するものとします。XAppSetは、プライバシーポリシーの定めに従って、これらのデータを取り扱い、使用します。
